Xai, a blockchain gaming firm, claims its AI business imitated its brand, causing consumer confusion and tarnishing its reputation since 2023.
Populus, the owner of the Ethereum-based gaming network Xai, has sued AI company xAI, owned by Elon Musk. They filed a lawsuit challenging the illegal use of their trademark as well as the unfair competition. The suit was filed in the Northern District Court of California.

Beginning in June of 2023, Xai has been using its trademark in public. It enables blockchain-based gaming and digital transactions through its own $XAI token.
According to the company, xAI, introduced by Musk in July 2023, resulted in significant confusion. The misunderstanding escalated in November 2024. At that time, Musk unveiled the new gaming studio that xAI had established.
This created confusion about the two companies being associated among many, including the users and the media. Even Musk’s AI assistant Grok confused the brands.
The threat to key brands and reputation is looming.
Populus emphasizes that it is not only profits that are lost through the damage. They are hit with a hypothetical poor consumer opinion. This is as a result of the high-profile image and controversy that are linked with products manufactured by xAI.
Their lawsuit reveals the way in which Musk and his legal team had intimidated them into renouncing their trademark.
The US Patent and Trademark Office has halted a number of trademark applications by Musk. This was because there was a high possibility of confusion with the existing brand of Xai.
Populus is going to look into the possibility of having all of the xAI trademarks that are associated with blockchain and gaming canceled.
They want financial compensation for the injury. They are also seeking a court order to bar further use of the disputed name in those areas.
The company focuses on the protection of the rights of smaller innovators. The innovation and fair competition are said to be harmed by the replication of smaller brands by big tech giants. Ensuring trademarks are of the essence to the whole gaming community, depending on Xai.
AI Chatbot Grok Mixes Up Brand
The lawsuit explains how Grok, Musk’s chatbot, lied that Xai blockchain and xAI gaming were part of his companies. The misleading information added to the confusion and damaged the image of Xai.
Populus says there was no way of ignoring this confusion. The brand should be defended as it is a priority according to the Trademark law. They continue to work on developing innovative blockchain games and struggle to defend themselves in a lawsuit.
